Qualification
There are a number of different disability programs in the Social Security system. In order to qualify for these programs, you must be considered disabled as defined by the Social Security Act.  Social Security defines disability as the inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment(s) which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.  
Please note that you do not have to wait 12 months to apply.  You may apply immediately if your disability in “expected to last” at least 12 months.
Children may also qualify for Social Security benefits if they have a significant impairment that affects various aspects of their life. There are different guidelines for disabled adult children, disabled widows or widowers, and the blind.
First Step
The first step is to make an application for benefits.  To apply for disability benefits you need to contact the Social Security Administration. The number to call is 1-800-772-1213. This number is quite frequently busy.  You can also get information through their web site at www.ssa.gov
If you have been denied
For your initial application, an attorney or non-attorney representative is most likely not necessary. If you are denied, you may want to seek representation to assist in presenting your case for your appeal.  There is no requirement that you have an attorney represent you in the Social Security process. Statistically, however, it more likely that you will be able to win benefits if you have an attorney represent you than if you pursue the benefits on your own.  
How much does it cost?
The Social Security Act controls what attorneys may charge. Generally, attorney fees are based upon the amount of the back Social Security award. 
All fees charged in Social Security and SSI disability cases must be approved by the Social Security Administration. This usually amounts to 25 percent of the past due benefits up to a maximum of $5,300, whichever is less.  You Pay No Attorney's Fee Unless We Win.  No fees are taken out of your future monthly benefits.

Clients may be billed for the costs of medical records and office expenses incurred after the case is finished. The expenses may include a doctor's bill if we hire one to conduct an evaluation of your mental or physical impairment.
